We understand that retailing can be an unpredictable business. Unforeseen circumstances can arise, and plans can change, that’s why we offer flexible contract terms and services to suit any business – from start-ups to mature, established businesses.
If you do need to cancel with us, it’s important you understand the termination terms in the Eftpos Services Agreement.
We’ve explained some of the details in the FAQs below. If you’re still unsure give our customer services team a call on 0800 EFTPOS (0800 338 767, option 4).
Where is my contract?
When you first sign up with Eftpos NZ we will send you a Letter of Offer and Acceptance which details your services, contract commencement date and any applicable fees including discounts and free periods.
Your Letter of Offer and the Eftpos Services Agreement are the legally binding terms you agree to when you use our services.
I didn’t sign the contract; how can it be legally binding?
When you sign up with us your Eftpos NZ sales representative will confirm that the terms will start on the commencement date on your Letter of Offer, that the documentation does not require a signature to become effective, and that your contract will automatically renew for further 12 month periods and then collect a verbal agreement from you before processing your onboarding documentation.
How can I cancel my contract?
You can terminate the agreement without penalty within 10 business days of your commencement date or before you start using the services. However, if you start using the services or 10 business days elapses then termination of the agreement is governed by the terms of the Eftpos Services Agreement.
You can terminate your contract with us at the end of your initial term and each subsequent term by giving 90 days written notice. This notice period is an industry-standard. See how to contact us here if you intend on providing notice.
Note that if you do not provide written notice, your contract will renew for a further 12 month period.
If you are selling your business, you can transfer your Eftpos NZ contract to the new owner which means you won’t have to pay the balance of the charges on your contract. See what’s involved in transferring your Eftpos NZ contract here.
Is there a cancellation fee?
If you terminate your agreement within the current term without providing 90 days written notice we won’t charge you a cancellation fee, but you will be invoiced for the balance of any charges that would have been payable up to the end of the current term.
Why am I still being charged?
If you terminate your agreement with us it is your responsibility to cancel any automatic payments you have set up to make payment to us and return your equipment to us. Please note that if you do not return all Eftpos NZ owned equipment, we will continue to charge you.
